The short version

These Terms of Service apply to your use of winwaypictures.com and to all sessions and projects booked with Winway Pictures ("we," "us," Justin Winans). By using this site, paying a deposit, or booking a session, you agree to them. For commercial projects, a separate signed agreement may supplement or replace these terms.
Using this website
All photographs, videos, text, and design on this site are the copyrighted property of Winway Pictures (or used with permission) and are protected by U.S. copyright law. You're welcome to browse and share links, but images and content may not be copied, downloaded, scraped, or republished — commercially or otherwise — without our written permission. Client galleries come with their own print release, described below. Brand names mentioned on this site are the trademarks of their respective owners and indicate past work, not endorsement.
The site is provided "as is." We work to keep it accurate and available but can't guarantee it will be uninterrupted or error-free, and we aren't liable for damages arising from use of the site itself. Links to third-party services (Instagram, TikTok, YouTube, Calendly, Venmo) are governed by those services' own terms.
Booking & deposits
A session is confirmed when your deposit is received. Mini-session deposits are $125; other sessions and projects require the deposit stated in your quote (typically 50% for web and commercial projects). Deposits are non-refundable but never expire — they transfer in full to any future date if you need to move your session.
Rescheduling & cancellation
- You need to reschedule: tell us as soon as you can. Your deposit transfers to any available future date, no questions asked.
- Weather or conditions beyond anyone's control: outdoor sessions move to the announced backup date, or another date we agree on. Your deposit carries over.
- We have to cancel (illness, emergency, equipment failure): you choose a full refund of everything paid, including the deposit, or priority rebooking.
- You cancel outright (no reschedule): amounts paid beyond the deposit are refunded; the deposit is retained as a booking fee.
- Late arrivals & no-shows: arriving more than 15 minutes late to a mini session may reduce your shooting time; a no-show forfeits the deposit.
Payment
The remaining balance is due on or before the session date. Galleries and final deliverables are released after payment in full. Prices shown on this site are starting rates; your total, including any applicable Connecticut sales tax, is confirmed before booking.
What you receive
Each package lists its included edited images and delivery timeline. Editing style, image selection, and final counts are at our professional discretion. Unedited files (RAWs) are not included or sold. We make every reasonable effort to deliver on the stated timeline and will tell you promptly about any delay.
Image rights — yours and ours
- Your use: personal-session galleries include a print release — download, print, and share your images for personal, non-commercial use. Commercial clients receive the usage rights stated in their quote or agreement.
- Our use: we retain copyright in all images. We display client images publicly (website, portfolio, social media) only if you've signed our photo release. You can decline or limit this at booking — it never affects your price or service.
Limitation of liability
We carry out every session with professional care. If images are lost or unusable due to camera failure, memory-card corruption, theft, or similar events beyond our control, our liability is limited to a reshoot or a refund of amounts paid for that session, at your choice. We are not responsible for missed moments caused by venue restrictions, weather, or participants' availability. To the fullest extent permitted by law, our total liability for any claim — relating to a session or to this website — is limited to the amount you paid us.
Safety
During sessions, parents or guardians remain responsible for supervising their children at all times.
